Terms of Service

These Terms of Service (“Terms”) govern your access to and use of smaartcoach (the “Service”), an AI fitness coaching service delivered through WhatsApp. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Important health notice. smaartcoach provides general fitness and nutrition information for educational purposes only. It is not medical advice and is not a substitute for a doctor, registered dietitian or qualified professional. Consult a physician before starting any exercise or nutrition program, especially if you have a medical condition, are pregnant, or take medication. You exercise at your own risk.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements.

2. The Service

smaartcoach lets you log meals (by photo, voice or text) to estimate calories and macros, request and follow guided workouts, ask an AI coach questions, and track your progress, all inside WhatsApp. Features may change, improve or be discontinued over time.

The Service relies on artificial intelligence. AI outputs, including calorie/macro estimates, workout suggestions and answers, may be inaccurate or incomplete. Use your judgment and do not rely on them as professional, medical or nutritional advice.

3. Your account & conduct

You are responsible for the information you provide and for activity conducted through your WhatsApp number. You agree not to misuse the Service, including: using it unlawfully; attempting to disrupt or reverse engineer it; uploading content that infringes others’ rights; or using it to harm yourself or others.

4. Subscriptions, billing & cancellation

The Service is offered on a paid subscription basis. Pricing and billing period are shown at checkout.
Payments are processed by a trusted third-party payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Subscriptions renew automatically at the end of each period unless cancelled beforehand.
You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
Except where required by law, payments are non-refundable. We may change prices with reasonable advance notice; changes apply to the next billing period.

5. Third-party services

The Service is delivered over WhatsApp and uses third-party providers (see our Privacy Policy). Your use of WhatsApp is also governed by Meta’s terms and policies. We are not responsible for third-party services we do not control.

6. Intellectual property

The Service, including its content, software, exercise library, branding and the smaartcoach name and mascot, is owned by us or our licensors and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial use. You retain ownership of the content you submit and grant us a license to use it solely to operate and provide the Service.

7. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that results will be achieved.

8. Limitation of liability

To the maximum extent permitted by law, smaartcoach and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, or personal injury, arising from or related to your use of (or inability to use) the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the event giving rise to the claim. Nothing limits liability that cannot be excluded under applicable law.

9. Indemnification

You agree to indemnify and hold smaartcoach harmless from claims, damages and expenses arising out of your misuse of the Service or violation of these Terms.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.

11. Governing law & disputes

These Terms are governed by applicable law. Disputes will be handled by the courts that have proper jurisdiction, and nothing here removes the mandatory consumer-protection rights you have in your country of residence (for example, in Brazil or the EU).

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and update the “Last updated” date; continued use after changes means you accept them.
